Participant Waiver

1. Participant Waiver & Liability Agreement: I understand there are inherent risks associated with playing all sports and related activities. In consideration for the privilege to engage in NEXT22CHAPTER LLC’ (the “Principal”) recording of a basketball game, display of skills, and other physical exhibitions of athletic prowess (the “Program”), my signature indicates I assume the risk of any injuries that myself or my child (the “Participant”) may sustain while participating in Program and for any injuries which Participant while on the location of the Program.  I ensure the Participant is physically and mentally able to participate in the Program and have been examined by a licensed medical physician within one (1) year prior to participating in the Program.

I give permission for the Principal and the Program’s Producer, their officers and employees, and each and all persons involved in the Program or contracted health care to start preliminary treatment and arrange transportation for the Participant to a local Emergency Room in the event that Participant become(s) ill or injured.

2. Authorization and Acknowledgment: By signing this waiver and consent, I, the Participant or the legal parent/guardian of the Participant grant permission for Participant to participate in any and all Program activities that may include but not limited to stretching, warmups, cardiovascular activities, walking, jogging, jumping, running, throwing, sudden lateral movement, physical contact with others older or younger than participant or higher or lower skill levels, lifting, dribbling a ball, diving on a hard surface, and all activities associated with playing the game of basketball in a gym or outdoor setting unless otherwise specified. I recognize and acknowledge the inherent risks that these activities may present for Participant. 

I acknowledge that the possession or use of alcoholic beverages and illegal drugs are strictly forbidden. I understand the possession of any weapon (firearm, knife, explosives, etc.) is strictly forbidden during all Program activities. I acknowledge the risks of attending the Program activities and the Participant’s participation in the Program, I agree to release and hold harmless the Principal the Program’s producer, their officers and employees, and each and all persons involved in the Program and its founder, trustees, directors, officers, employees, agents, affiliates, volunteers and medical staff (“Staff”) from any and all injury claims of any other nature which may result from Participant’s participation at and travel to or from the Program’s location. I agree to indemnify and hold the Principal its Staff and other participants involved with the Program at any time harmless from any and all liability caused by Participant, whether or not intentional. 

3. Medical Consent: The Principal or Staff will make every effort to contact me in the case of an emergency. I give my permission for the Principal, Staff, or any other person involved with the Program and its medical staff to administer any medications needed and to provide and arrange for any necessary medical treatment to Participant while at the Program location including onsite and offsite emergency care. I accept responsibility for the costs of all such medical treatment.

By signing this Waiver and Liability Agreement, I acknowledge that I HAVE READ AND FULLY UNDERSTAND AND AGREE TO ALL OF ITS TERMS AND CONDITIONS INCLUDING PERMISSION TO TREAT AGREEMENT. I further state that I have executed this waiver and liability voluntarily and with full knowledge of its significance to be binding on my, my heirs, executors, administrators and assigns.

Consent and release

CONSENT AND RELEASE INTERVIEW, PHOTOGRAPHING, VIDEOTAPING, WEBSITE, AND/OR SOCIAL MEDIA USE

I, the undersigned (the “Participant”), have the desire to participate in a recorded basketball game, display of skills, and other physical exhibition of athletic prowess (the “Program”) as being conducted by NEXT22CHAPTER LLC, its heirs, associates, assigns, and companies (hereafter referred to as the “Producer”).  As a precondition to participating in the Program, I have read the following Agreement (the “Agreement”) and agree to its terms.

  1. Release: I consent to interview(s), photography, videotaping and its/their release, publication, exhibition, or reproduction to be used for public relations, news articles or telecasts, education, advertising, research, inclusion on websites, streaming platforms, social media platforms, and other digital distribution platforms known to exist now or at any time in the future within the known universe, for business, fundraising, or any other purpose by Producer and/or its affiliates.  I release Producer, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, or publication of said interviews, photographs, slides, images, videotapes, or sound recordings.

I waive all rights I may have to any claims for payment or royalties in connection with any exhibition, televising, or other publication of these materials, regardless of the purpose or sponsoring of such exhibiting, broadcasting, or other publication, irrespective of whether a fee for admission or film rental is charged. 

I also waive any right to inspect or approve any photo, video, or film taken by Producer or the person or entity designated by Producer.  I release and discharge Producer and their affiliate(s) from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of the pictures, or any processing toward the completion of the finished product.  All negatives and positives, whether prints, video, film, or sound recording, are the property of Producer or the person or entity designated by it, solely and completely.

  1. Conduct:  I acknowledge and agree that this is a supervised program and that group standards must be observed.  I hereby waive and release all claims against Producer and its agents related to my failure to cooperate with such supervision or any failure to comply with such instructions from Producer.  I acknowledge and agree that Producer shall have the right to enforce appropriate standards of conduct and that it may at any time terminate my participation in the Program or attend activities associated with the Program for failure to maintain these standards or for any conduct which Producer considers to be incompatible with the interest, harmony, comfort, and welfare of others.

  2. Intent: It is my express intent that this Agreement shall bind the members of my family and spouse (if any), my estate, heirs, administrators, assigns, and personal representatives.  I agree that this Agreement and any claim arising from my participation in the Program shall be construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provision.  The courts in Hillsborough County, Florida, shall be the proper forum for any lawsuits arising from the Program or any incident related to this Agreement.  The terms of this Agreement shall be severable, such that if a court of competent jurisdiction holds any term to be illegal or unenforceable, the validity of the remaining portions thereof shall not be affected thereby.

In signing this Agreement, I acknowledge that I have carefully read this Agreement.  I understand the contents of this Agreement, and agree to be bound by its terms.  I further acknowledge that I sign this Agreement voluntarily and I am at least eighteen years of age, and if I am not eighteen years of age, my parent/legal guardian shall sign and agree to the above on my behalf.
